The Attorney General of the State, Dolores Delgado, has set the plenary session for the constitution of the new Fiscal Council for June 29, according to tax sources reported to EL MUNDO. The elected members of the body have received a communication signed by the inspector prosecutor, María Antonia Sanz, where they are summoned for that day at 12 noon at the headquarters of the State Attorney General’s Office, which is located on Fortuny street in Madrid.
Despite the fact that the attorney general is still on medical leave after undergoing back surgery, Delgado hopes to be able to preside over the act, according to the sources consulted. The former Minister of Justice thus responds to the claim made by the members of the majority Association of Prosecutors (AF) who last week sent her a letter requesting that “as soon as possible” proceed to the constitution of the Fiscal Council.
The truth is that there was some discomfort in the fiscal career because almost a month after the elections to the advisory body were held, there was still no scheduled date for the body to start operating. Not in vain in previous mandates, the constitution of the Fiscal Council, once the final results of the elected members were published, was done within a period of between five and seven days after the publication of the lists.
In the event that Delgado continues on medical leave on June 29, the attorney general may be replaced by the deputy prosecutor of the Supreme Court, the prosecutor of Sala Ángeles Sánchez Conde. Article 6 of the royal decree that regulates the operation of this body states that “in the event of a vacancy, absence or illness, the State Attorney General will be replaced in the presidency of the Plenary and of the Permanent Commission by the deputy prosecutor of the Supreme Court ».
In the last elections to the Fiscal Council, the AF swept, the Independent Professional Association of Prosecutors achieved representation for the first time and the former association of Dolores Delgado, the Progressive Union of Prosecutors, reduced its representation by half.
