The titular magistrate of the Court of First Instance and Instruction number 4 of Siero, has issued this Friday a provisional prison order, communicated and without bail in open proceedings for assault on a 12-year-old girl, notwithstanding that said qualification could be modified.
The judge has adopted this decision after the Prosecutor’s Office considered that these could constitute a crime of sexual assault with a minor under 16 years of age, punishable by a minimum sentence of 10 years and 1 day in prison for the expected aggravation.
The reason is that the victim was in a situation of special vulnerability due to her age, 12 years old, and due to the particular circumstances of the place of the commission, a remote place with difficult access and inside a tent.
The magistrate maintains that there is sufficient evidence to understand that the detainee is the alleged perpetrator of the events, which occurred on May 15, 2021, around 1:40 p.m., and that the provisional detention measure is necessary and proportional to the seriousness of the events. .
