Local Supermarket Defeats Nintendo in Trademark Dispute

The supermarket, run by a father and son duo, has been operating for decades under the name “Super Mario.” When the son attempted to renew the supermarket’s registered trademark last year, Nintendo, known for aggressively protecting its intellectual property, stepped in to challenge it.
Facing off against what they described as “such a commercial monster,” the family wasn’t sure how they would be able to win the fight. Mario’s son even considered throwing in the towel at one point. However, with the help of their legal and accounting advisor, José Edgardo Jiménez Blanco, they decided to stand their ground.
After a long legal battle, the National Register of Costa Rica ruled in favor of the local supermarket. Despite Nintendo holding trademarks for “Super Mario” in various categories, the authority found that supermarkets and the “sale of groceries” were not included in Nintendo’s trademarks.
The supermarket’s logo, which reads “Super Mario – Su lugar de confianza” or “Super Mario – your trusted place,” bears no resemblance to the famous video game character. To celebrate their victory, the supermarket is offering free stickers with their logo to customers who visit the store.
“This is a giant step towards our vision and the reason a company this big is getting picky is because we are making ourselves noticed. SUPER MARIO is here to stay,” said the family in a statement.
While this victory is a significant win for the local supermarket, it also highlights the challenges faced by small businesses when going up against large corporations in legal disputes. Nintendo, known for its aggressive protection of its intellectual property, may have to rethink its strategy when it comes to trademark battles with smaller entities.
